Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DriveSmart apps, website and admin portal (the “Service”), operated by Software Ladders (“we”, “us”, “our”).

1. Eligibility & accounts

• You must provide accurate information and be legally eligible to begin driver training in your country.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• You may not share, sell or transfer your account.

2. The Service

DriveSmart provides driver-education content including courses, a traffic-sign library, mock theory exams, hazard-perception practice, driving simulations, and verifiable certificates. Content is designed to help you prepare; it does not replace the official driving test or any legal requirement set by the relevant authorities.

3. Plans, pricing & payment

• We offer a free tier, a paid Learner plan (monthly subscription or a one-time payment), and custom School plans.
• Prices are shown in Kenyan Shillings (KES); your local currency and payment method (such as M-Pesa or card) are applied at checkout.
• Subscriptions renew automatically until cancelled. You can cancel anytime; access continues until the end of the paid period.
• One-time “until you pass” access: a single payment gives access until you pass your theory test, or for one year from purchase — whichever comes first.
• Refunds are governed by our Refund Policy.

4. Certificates

Certificates are issued for completed courses or passed exams and include a unique verification number and QR code. Certificates confirm completion of DriveSmart training only; they are not a government-issued licence. Misusing, forging or altering a certificate is prohibited.

5. Acceptable use

• Do not copy, resell, scrape or redistribute our content without permission.
• Do not attempt to disrupt, reverse-engineer or gain unauthorised access to the Service.
• Do not upload unlawful, infringing or harmful content, or impersonate others.

6. Driving schools & partners

Partner schools may receive additional tools (dashboard, bulk enrolment, co-branding, revenue share) under a separate partnership agreement. Schools are responsible for their learners’ data handling within their own programme.

7. Intellectual property

The Service and its content are owned by Software Ladders or its licensors and protected by law. We grant you a limited, personal, non-transferable licence to use the Service for your own learning.

8. Disclaimers

The Service is provided “as is”. While we work to keep content accurate and up to date with local road rules, we do not warrant that it is complete, error-free, or that using it guarantees passing any test. Always follow the current rules and instructions of the relevant road-safety authority.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss arising from your inability to pass a test or obtain a licence. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully.

11. Governing law

These Terms are governed by the laws of Kenya for users in Kenya. Where you use the Service from another country, local mandatory consumer-protection laws may also apply.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
